Effect Of Contributory Negligence In A New Jersey Car Crash

H2Oi Wildwood: 2 killed during ‘unsanctioned’ car event 1 arrested

What will happen if the car accident victim is partially to blame for the accident or for the severity of his or her injuries? Under New Jersey contributory negligence law, as long as a plaintiff is not 51 percent or more to blame, then that plaintiff is still permitted to recover. However, a plaintiffs award is reduced by his or her percentage of liability.

For example, if a court determines that a plaintiff is 25 percent liable and awards the plaintiff a total of $100,000, that award is reduced by the plaintiffs percentage of fault. Accordingly, the $100,000 award would be reduced by 25 percent , and the plaintiff would recover $75,000.

Once a plaintiffs negligence is greater than the defendants , then the plaintiff is barred from any recovery.

An Experienced New Jersey Car Accident Lawyer Can Help

If you are involved in a crash, you can help with the determination of fault. For instance, if your condition allows, you can take photos at the crash scene and gather contact information of eyewitnesses. This information will help your lawyer to conduct an investigation. Additionally, you should take a few moments to write down what you recall about the accident while those details are still fresh in your memory.

The bottom line: Determination of fault is important in a New Jersey car accident lawsuit. Dont leave that determination to an insurance company. Instead, work with an experienced auto accident attorney who will get the facts straight and ensure that your story gets told.

Statute Of Limitations For A Car Accident In New Jersey

GSP: NJSP Release Details from Yesterdays Serious Crash in Barnegat ...

If you are involved in a motor vehicle crash in New Jersey and need to take your case to trial, it is important to pay careful attention to the statute of limitations in a personal injury lawsuit. A car accident plaintiff has two years from the date of the injury to file a claim for compensation. Failure to file a claim within the two-year period specified in the statute can result in the plaintiffs claim becoming time-barred.

Once a claim is time-barred, an injured car accident victim cannot file a lawsuit to seek compensation, regardless of the severity of the injury or clear-cut fault. While two years might seem like a long time, it can take months to go through the insurance claims process.

Until you file an insurance claim, you will not know whether you need to take your case to trial. Further, the longer you wait to get started on your claim, there is a greater chance that evidence can be lost. You should begin working with an experienced New Jersey car accident attorney today to ensure that you remain eligible to receive compensation.

Truck Accidents On The Nj Turnpike

The Turnpike is the main throughway between New York and Philadelphia and a major route for commercial trucks carrying goods. The highway connects to Port Elizabeth, the largest port on the East Coast, and there are numerous FedEx and UPS hubs up and down the state. Popular online retailers including Amazon and Newegg.com also have distribution centers in the state, which contribute to the high number of commercial vehicles on the road.

In the northern part of the state, the highway is separated into a section for cars only and a section for cars, trucks, and buses. South of exit 8, however, the roadway merges, and drivers who are not prepared for the change in traffic pattern might be at risk of an accident. Truck accidents can be considerably deadlier than accidents with smaller vehicles due to their size and weight. Tractor trailers need a longer stopping distance to avoid obstacles and shifting or falling cargo can make them more prone to tip over.

Establishing Liability In Fatal Car Accidents

Establishing liability in a fatal accident can be complex. Your family member is no longer here to say what happened. Unless there are witnesses, police only hear one version of the accident: that of the other driver.

Determining who was responsible can be complex and may involve comparative fault. In New Jersey, your family members can still file a wrongful death lawsuit if your loved one was up to 50 percent at fault as long as he or she was not more than 50 percent at fault. Your recovery will be reduced by any percentage of fault that is assigned to your loved one.

Our New Jersey car accident lawyers work with prominent independent experts in the field of accident reconstruction to ensure that the accident receives a full and fair investigation. You will pay no attorneys fees or other costs until and unless we recover compensation for you. We often represent multiple family members who are entitled to compensation under New Jerseys wrongful death statute.

Increases In Traffic Deaths In Nj Are An ‘escalating Emergency’

Cathy Chase, the president of the Advocates for Highway and Auto Safety, said the increases in New Jersey and elsewhere reflect an “escalating emergency.”

The nationwide increases in traffic fatalities since 2019 are the highest percentage gains seen since the 1970s, according to federal data. Government agencies have responded with programs. The federal Speeding Wrecks Lives campaign and Trenton’s Wheels Risk program have launched amid the pandemic to spread awareness about the dangers of speeding and driving while impaired, respectively.

Speeding-related deaths went up 23% from 2019 to 2020 as the COVID-19 pandemic kept congestion down, federal records show. Moreover, the rate of drivers testing positive for opioids nearly doubled over the six-month period following March 2020 from the preceding period, U.S. Department of Transportation records show.

Chase has called for more crash avoidance technology in vehicles, such as automatic emergency braking and blind-spot detection devices, to combat the trend.

“With each passing day, road users are needlessly in peril,” she said in a statement. “We cannot pin our hopes to address the fatality toll on educational awareness campaigns, which have been implemented for decades, and the future possibility of autonomous vehicles.”
